1. Overview and Quality Assurance
This Refund Policy governs financial restitution for goods purchased through www.unipumps.co.za. To ensure the highest standards of reliability, all products are rigorously tested for functionality and integrity before leaving our warehouse to ensure they are free from defects at the point of origin.
By completing a purchase, the customer acknowledges that:
1.1. Risk Transfer: The risk of loss or damage is transferred to the customer the moment they, or their designated representative, take physical possession of the item (e.g., delivery at your door or gate).
1.2. Insurance: UniPumps offers an optional insurance add-on at checkout to protect the customer against transit-related damages before possession is taken.
1.3. Compliance: This policy is drafted in accordance with the CPA (Act 68 of 2008) and ECTA (Act 25 of 2002).
2. The “Cooling-Off” Period (ECTA Section 44)
In terms of Section 44 of the ECTA, a consumer is entitled to cancel an electronic transaction without providing a reason within seven (7) days of receiving the goods.
2.1. Full Refund: If this right is exercised, UniPumps will refund the full purchase price including the original delivery costs paid by the customer, provided the goods are returned in their original packaging and remain in the same merchantable condition as when they were dispatched, subject to the statutory provisions regarding material defects.
2.2. Return Logistics: The cost and arrangement of returning the goods to UniPumps are the sole responsibility of the customer.
2.3. Exclusions: This cooling-off period does not apply to goods made to the customer’s specifications (custom-made pipe configurations).
3. Technical Assessment and Forensic Inspection (Electronics)
UniPumps specializes in sensitive electronic components, including Capacitors and Pool Lights, which are susceptible to damage from improper installation or electrical surges.
3.1. Forensic Inspection: All returned electronic components are subject to a mandatory technical and forensic inspection.
3.2. Grounds for Denial: A refund or replacement will be strictly denied if the inspection reveals evidence of:
3.2.1. Electrical surges or “blown” components (distinguishable by burn marks).
3.2.2. Incorrect or amateur wiring.
3.2.3. External physical damage or vandalism.
3.3. Pre-Installation Defects: If a device is found to be defective prior to installation, UniPumps will provide a replacement part subject to the successful verification of the defect.
4. Non-Refundable Items and Custom Goods
The following items are strictly non-refundable due to their technical nature or custom specifications:
4.1. Custom-Made Goods: Any parts or pipe combinations manufactured specifically to customer-provided structural configurations.
4.2. Seals and Gaskets: Once removed from packaging, these cannot be refunded as their sealing integrity in pressurized environments can no longer be guaranteed.
5. Defective Goods and Limited Warranty
Under Section 56 of the CPA, goods carry an implied warranty of quality for six (6) months.
5.1. Scope: This warranty covers the product cost only.
5.2. Logistics: The customer is responsible for all logistics and shipping costs associated with returning the item for warranty claims and the subsequent delivery of any repaired or replacement items.
5.3. Exclusions: This warranty does not cover “fair wear and tear,” damage from improper water chemistry, or failure to use a qualified technician for installation.
6. Methods of Reversal and Fraud Prevention
Refunds are processed using the original payment method to maintain financial security.
6.1. Gateway Reversal: Where possible, refunds will be reversed through the original payment gateway (e.g., Ozow or PayPal) to avoid handling sensitive banking data.
6.2. EFT Payments: For direct transfers, we may require a bank-stamped letter to verify account details and prevent fraud.
6.3. Processing Time: Please allow 7 to 14 business days for funds to reflect.
7. SADC and International Returns
For customers in SADC countries (e.g., Namibia, Botswana, Zimbabwe), the following international standards apply:
7.1. Currency: All transactions and refunds are processed in South African Rand (ZAR). UniPumps is not liable for exchange rate fluctuations.
7.2. Import/Export Compliance: Any returned item must be accompanied by the correct Commercial Invoice and original customs documentation. Failure to provide this will result in significant refund delays or denial due to customs clearance issues.
7.3. Statutory Fees: UniPumps does not refund import duties, taxes, or foreign clearing fees paid to authorities outside of South Africa.
8. Choice of Law and Jurisdiction
This Refund Policy and all transactions associated with UniPumps are governed by the laws of the Republic of South Africa. Both parties submit to the non-exclusive jurisdiction of the Gauteng High Court for the resolution of any disputes.
9. Verification of Professional Installation
To protect the integrity of our specialized equipment, any warranty claim regarding electrical components (including pumps and lights) must be accompanied by proof of professional installation.
9.1. Required Documentation: Customers must provide a copy of the installer’s valid Wireman’s License or a Certificate of Compliance (CoC) specific to the installation of the UniPumps product.
9.2. Failure to Provide: Claims for items damaged due to amateur installation, incorrect wiring, or lack of proper electrical protection will be summarily denied following our forensic inspection.
10. Restocking Fees for “Change of Mind”
While UniPumps respects the statutory right to return goods, the handling of specialized pool equipment incurs administrative and technical costs.
10.1. Open-Box Returns: For “change of mind” returns where the original packaging has been opened or damaged, but the product remains unused, a 15% restocking fee will be deducted from the refund amount to cover re-testing and repackaging.
10.2. Exclusion: This fee does not apply to the 7-day ECTA cooling-off period if the goods are returned in their original, sealed, and pristine condition.
11. Abandoned Goods and Collection Limits
If a refund or warranty claim is denied following a technical assessment, the customer will be notified via email and provided with the inspection report.
11.1. Collection Window: The customer has 30 calendar days from the date of the denial notification to arrange for the collection of their item from our Johannesburg facility at their own expense.
11.2. Disposal: Any items not collected within this 30-day window will be deemed “abandoned.” UniPumps reserves the right to scrap, recycle, or sell the item to recover storage and assessment costs without further notice to the customer.
12. Reporting Transit Damage and Shortages
UniPumps strives for perfection, but logistics involve third-party couriers.
12.1. Inspection on Receipt: Customers must inspect the exterior of the parcel for visible damage before signing the courier’s waybill.
12.2. 48-Hour Notification: Any internal damage or shortages (missing parts) must be reported to sales@unipumps.co.za within 48 hours of delivery.
12.3. Late Claims: Claims for transit damage made after this 48-hour window may be rejected as we are unable to claim against our marine and transit insurance providers after this period.
14. Voluntary In-Store Credit Preference
To expedite the resolution of a claim, UniPumps offers customers the choice between a traditional refund (subject to banking delays) or a Digital Store Voucher.
12.4. Benefit: Store vouchers are issued immediately upon approval of the return and are valid for 12 months.
12.5. Election: By selecting a voucher, the customer waives the 7-14 day banking wait time.
